1. Service Description
We provide coaching sessions and group events aimed at improving well-being. Services are delivered via in-person and online.
2. Disclaimer
We do not provide therapy or medical treatment. We do not diagnose or treat mental health disorders. If you require such services, please seek the advice of a licensed therapist or medical professional.
3. Payment Terms
- Fees: The fees for services are detailed on our website.
- Payment Method: Payments are processed through Stripe.
- Due Dates: For events and individual coaching sessions or packages, payment is due at the time of booking. For periodic coaching sessions, payment is due the day of the session.
- Late Payment: Late payments may result in cancellation of sessions.
4. Refund Policy
- Refunds are granted if a cancellation request is made at least 24 hours before the session.
- Refunds are not provided for no-shows or for cancellations made less than 24 hours before the session.
5. Dispute Policy
- Disputes should be reported within 30 days of the incident.
- We aim to resolve disputes amicably through direct communication.
- If unresolved, mediation or arbitration may be pursued.
6. Cancellation Policy
- Clients can cancel sessions with at least 24 hours' notice to avoid fees.
- A cancellation fee equal to the session cost applies for cancellations made less than 24 hours in advance.
- Events, unless otherwise specified, are non-refundable.
7. Confidentiality
- All information shared during sessions is confidential.
- We will not disclose any client information without written consent, except as required by law.
8. Liability Waiver
- General: Our services are provided "as is" without any warranties, express or implied. We do not guarantee any specific outcomes from our services.
- Risk Assumption: Clients agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which might occur as a result of participating in our services.
- Limitations of Liability: To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use our services;
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the services;
- Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our services;
- Any unauthorized access to or use of our servers and/or any information stored therein;
- Any interruption or cessation of transmission to or from our services;
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party.
9. Indemnification
- Clients agree to indemnify and hold harmless Back to Presence, LLC, its affiliates, and its respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:
- Client's access to or use of our services;
- Client's violation of this agreement;
- Client's violation of any rights of another.
10. Force Majeure
- Back to Presence, LLC will not be liable for any failure to perform due to causes beyond its reasonable control, including but not limited to acts of God, war, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
11. Severability
- If any provision of this agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this agreement will otherwise remain in full force and effect and enforceable.
12. Termination of Agreement
- Either party may terminate this agreement with written notice.
- Termination does not entitle the client to a refund for any services already booked or provided.
13. Data Privacy
- We collect and use client data in accordance with our Privacy Policy below, which complies with applicable laws.
- Clients have the right to access, modify, or delete their data.
14. Modification of Terms
We reserve the right to modify these terms at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the new terms.
By booking our services, you acknowledge that you have read, understood, and agree to these terms.
